General Terms and Conditions of Online Sale

Purpose – Scope

The present General Terms and Conditions of Sale and Use apply to all the products proposed on the iojt-bordeaux2011.org website managed by the French National School for the Judiciary. Product orders are reserved for users who have duly read the present General Terms and Conditions in full prior to each order. By placing an order, clients shall be deemed to have given their full and unreserved approval of the present General Terms and Conditions of Sale and to have accepted the prices and products available for sale.
The French National School for the Judiciary reserves the right to modify the present General Terms and Conditions at any time without prior notice, but it is understood that any such modifications shall not apply to orders accepted previously.

Product Information

The website presents the main features of the products on offer. The products offered by the ENM are governed by the present General Terms and Conditions of Sale and are valid as long as they remain online and until they are no longer available.
The features of the products and services are likely to be modified or improved at any time.
Therefore the photographs and texts describing the said products and services are in no way contractually binding.

Orders

The client must confirm their acceptance of the present General Terms and Conditions by checking the corresponding box.
An order may only be confirmed once this box has been checked. All orders confirmed by the client are deemed to have been irrevocably accepted.
The automatic record systems of the website are considered as providing proof of the sale contract and its date.

Cancellation Terms

For any cancellations requested before 1st October 2011, no sums shall be due. Enrolment fees shall be refunded in full.
For all cancellations requested from 1st October 2011: the amount shall remain due in full. No refunds shall be made.

Order Fulfilment

Orders are recorded and processed by the administration. The School undertakes to honour the orders received on its iojt-bordeaux2011.org website only subject to available stocks. Should any products or services ordered be unavailable, the client shall be informed to this effect promptly and contacted to agree on how to proceed with the order.

Prices

Participants:

Enrolment includes at least:

  • Access to the 6 half-days: plenary sessions, panel discussions, themed workshops.
  • Access to the welcome cocktail, the 4 lunches, the coffee breaks, the wine-tasting session and the cold buffet of Monday 31 October and the Gala Dinner on Wednesday 2 November.

Enrolment as a participant is charged at a flat rate of €550 net.

Accommodation, transport and transfers are not included in the flat rates.

Accompanying person

Enrolment includes at least access to the welcome cocktail, the 4 lunches, the coffee breaks, the wine-tasting session and cold buffet on Monday 31 October, and the gala dinner on Wednesday 2 November.
Enrolment as an accompanying person is charged at a flat rate of €220 net.
Accommodation, transport and transfers are not included in the flat rates.

Sightseeing tours

The sightseeing tours organised by the ENM and proposed as part of the 5the IOJT Conference are charged at a flat rate of €20 net.
This flat rate includes transport and the admission fee.

Payment

Validation of the order by means of the user’s credit card number and expiry date shall be considered as an order to pay the full amount of the order. The online payment team accepts the following credit cards: Visa, MasterCard, E-Carte-Bleue, PayPal, American-Express, 1Euro.com, Cofinoga, Cetelem, Privileges, Sofinco, Diners Club, JCB, prepaid gift cards... The data relating to the credit card is only stored for the time required to process the order.
Should the payment turn out to be irregular, incomplete or inexistent for any reason attributable to the client, the sale shall be cancelled.

Nominative information

The information requested of the client is necessary for processing the order. It will be saved to an ENM client file and may be communicated to the ENM’s contractual partners involved in order processing.
In accordance with the French "Computer Technology and Freedom" law of 6 January 1978, clients have the right to access, amend and rectify the personal data that concerns them.

Cryptography

The French National School for the Judiciary (ENM) guarantees that the cryptography systems and services used to secure transactions have been authorised or declared in application of the legislation in force.

Electronic Signature - Proof

Validation of the order form combined with the procedure for authentication and protection of the integrity of messages constitute an electronic signature which has the same value between the parties as a handwritten signature.
The computer records kept in the computer systems of the French National School for the Judiciary under reasonable conditions of security shall be considered as proof of communications, orders and payments between the parties.
Order forms and invoices are archived on a reliable, irreversible medium in such a way as to represent a true and sustainable copy, in the sense of Article 1348 of the French Civil Code.

Severability

If any one of the provisions of the General Terms and Conditions should be declared to be null and void it shall be deemed not to have been written, without this having any effect on the validity of the other provisions, unless the provision declared null and void was an essential and decisive one.
The fact that the ENM might not invoke one of the present General Terms and Conditions in its relations with the client shall not be interpreted as a waiver of the right to invoke the said provision at a later date.

Use of the internet site

The ENM provides no guarantee that the site is free of any anomalies, errors or bugs, nor that any such may be corrected, nor that the site will operate without interruption or breakdowns, nor that it is compatible with any particular hardware or configuration.
Under no circumstances shall the ENM be liable for any damage, foreseeable or not, arising from use of the site or if it should prove totally or partially impossible to use the site.
Users declare that they are familiar with the characteristics and limits of the internet, and in particular of its technical performances, response times for viewing, searching or transferring data and the risks relating to telecommunications security.

Intellectual Property

The ENM holds all the intellectual property rights to the website or the related rights of use.
Access to the site in no way grants any intellectual property rights relating to the site, and all such rights shall remain the exclusive property of the ENM or its partners.
All the elements accessible on the site, notably in the form of texts, photographs, images and data, are also protected.

Applicable Law – Dispute Settlement

The contract is governed by French law. The courts of Bordeaux shall be competent in the event of any disputes.
